Terms of Service

Please read the following terms carefully before commissioning or using my artwork.
By commissioning me or using my art in any way, you agree to these terms.

  1. Ownership & Usage Rights
    My artwork is for personal use only, unless commercial rights have been explicitly purchased.
    If you intend to use my art for commercial purposes (e.g., merchandise, promotion, monetized platforms), you must disclose this upfront when submitting your commission request.
    Failure to state commercial intent may result in the cancellation of your commission or additional fees being charged.

  1. Reselling & Redistribution
    Do not resell, trade, or redistribute my art without my explicit consent.
    If you are selling or trading a character that includes my artwork, you must contact me directly (@heartey on Discord) for permission before proceeding.

  1. Credit & Watermarks
    Do not remove or alter my watermark under any circumstances.
    When reposting or sharing my art online, you must credit me clearly (e.g., “Art by @heartey on Discord”).

  1. AI and NFT Usage
    Do not feed, upload, or use my art in any way for AI training, AI generation, or NFT projects.
    If I discover that my work has been used for such purposes, I will blacklist you from future commissions and cancel any ongoing projects immediately.

  1. Commission Process
    I reserve the right to decline or cancel a commission at any time if I am unable to complete it.
    Please do not rush me. Rushed requests may incur an extra fee or be voided entirely.
    Do not beg or pressure me for free art under any circumstance.

  1. Payment & Refund Policy
    Payment can be made in two parts:
    50% after receiving the initial sketch (to confirm continuation).
    50% after receiving the final completed artwork.
    Clients may also choose to pay in full upfront if preferred.
    If I cancel the commission for any reason on my end, you will receive a full refund.
    If you cancel after I’ve begun working, a partial refund may be issued depending on the progress made.
    Once the artwork is completed and delivered, it becomes non-refundable.

  1. Communication & Conduct
    Please communicate respectfully and clearly throughout the process.
    Harassment, rude behavior, or excessive demands will result in your commission being terminated without refund.

  1. Artist Rights
    I retain full copyright and moral rights to all my artwork.
    I may post or display commissioned works in my portfolio or social media unless you specifically request otherwise before the commission begins.

  1. Commercial Rights
    By default, all commissioned artworks are for personal use only.
    If you wish to use my art for commercial purposes—such as for merchandise, branding, promotional materials, or monetized platforms—you must purchase commercial rights at the time of commissioning.
    The commercial rights fee is typically an additional 150–300% of the base commission price, depending on the intended use.
    Purchasing commercial rights grants you a non-exclusive license to use the artwork for profit-generating or promotional purposes.
    I, as the artist, retain full copyright and ownership of the artwork. You are not permitted to claim, resell, or redistribute the art as your own.
    If you wish to obtain exclusive rights, this must be negotiated separately and will involve a higher fee.
    Failure to disclose commercial intent may result in commission cancellation or additional post-completion fees.

  1. Refund & Unauthorized Use
    If a commission is refunded for any reason, the client loses all rights to the artwork, including sketches or unfinished drafts.
    You are not allowed to use, post, share, trace, or edit any refunded artwork.
    If you are found using or sharing refunded artwork, you will be charged the full original commission price, regardless of progress made at the time of refund.

By commissioning me, you acknowledge and agree to all the terms listed above.
