Terms of Service & Conditions

By commissioning, purchasing, subscribing to, or otherwise engaging with Afterglow Atelier (“Afterglow,” “we,” “us,” or “the Artist”), you acknowledge that you have read, understood, and agreed to the following Terms of Service.
If something here feels firm—it is. Boundaries are how art stays intentional.
1. Eligibility & Age Requirement
All clients, subscribers, and viewers must be 18 years of age or older.
- All characters depicted in Afterglow content are explicitly 18+, regardless of appearance, style, or context.
- No exceptions. No “but technically.” No vibes-based loopholes.
2. Intellectual Property & Character Rights
Original Characters
Unless explicitly stated otherwise:
- All original characters, designs, concepts, and worlds created by Afterglow Atelier are the sole property of Afterglow.
- We reserve the full right to reuse, repost, modify, archive, monetize, or otherwise utilize our original characters and artwork as we see fit.
Commissioned Characters
- Characters owned by a client remain the intellectual property of their respective owner.
- However, Afterglow retains full rights to display the commissioned artwork for portfolio use, social media, Patreon, promotional material, and archival purposes.
Privacy Option:
If a client requests that commissioned work not be posted publicly, this must be arranged in advance and is subject to an additional privacy fee. Silence implies consent to post.
3. Content Limitations
Afterglow Atelier maintains firm creative and legal boundaries.
We do not create:
- Content featuring real people, including influencers, celebrities, or private individuals
- Content based on licensed, trademarked, or copyrighted characters not owned by the client
- Any material that would be considered illegal under the laws of the State of California
- Any content involving minors, age ambiguity, or age regression themes—period
If it’s questionable, the answer is no. If it’s illegal, the answer is also no—but louder.
4. Creative Discretion & Right of Refusal
Art is intimate. Trust matters.
- Afterglow Atelier reserves the right to decline, cancel, or discontinue any commission at our sole discretion.
- This includes requests that conflict with our values, creative direction, comfort level, or brand integrity.
If a commission is canceled by Afterglow:
- The client will receive a full or partial refund, depending on the stage of completion.
- No justification beyond “this does not align” is required.
Consent goes both ways.
5. Payments, Refunds & Cancellations
- Payment terms are agreed upon before work begins.
- Once work has started, refunds are evaluated based on progress made.
- Completed commissions are non-refundable unless otherwise stated in writing.
Chargebacks without prior communication may result in refusal of future service.
6. Usage & Redistribution
Clients may:
- Display commissioned artwork for personal, non-commercial use
Clients may not:
- Resell, redistribute, mint, train AI on, or commercially exploit the artwork without explicit written permission
- Remove watermarks or artist attribution where applicable
Commercial usage licenses are available upon request.
7. Changes to These Terms
Afterglow Atelier reserves the right to update or modify these Terms of Service at any time.
Continued use of our services constitutes acceptance of the most current version.
