Pornhub claims immunity after video shared of teen girl’s alleged rape

Pornhub asked a Birmingham federal judge on Wednesday to dismiss a lawsuit brought by an Alabama teen who claims she was raped and that the incident was posted to the adult website, claiming the company is immune to liability for what third parties post to the platform.
MindGeek, Pornhub’s parent company, said it was entitled to so-called Section 230 immunity, which it said gives Internet companies “broad immunity from liability for content posted to its websites by third parties.”
The 16-year-old Alabama girl along with an underage girl from California filed the suit in February, claiming Pornhub violated a number of laws, including the Trafficking Victims Protection Reauthorization Act , which allows victims to sue entities in civil court who benefit from “a venture that it should have known was engaged in a violation, including that an act involving a child 18 years of age or under constitutes a violation,” according to the complaint.
The teen said she was drugged and raped in 2018 by a Tuscaloosa man and that he uploaded video of the alleged rape to Pornhub.
In its filing Wednesday, Pornhub said it cannot be held liable under Section 230.
“Federal courts have consistently held under similar circumstances that such claims against websites for possessing child pornography are barred by Section 230,” the company said.
In addition to unspecified monetary damages, the girls’ lawsuit also asks Pornhub to develop measures to identify and remove child pornography from its adult sites.
