Terms Of Service

CLIENT

  • You, the Client, will be expected to first read my TOS and understand my general Commission Prices. By commissioning me, you are purchasing my service as an artist only, and by purchasing my services (art), you agree that you have read and accepted all the terms described herein.
  • Terms of Service and Prices are subject to change at anytime; with Crystgin commissions, even moreso as any price changes aren't done by me, the artist, and is done instead by Netease. Thus, you are only subject to the ToS and prices agreed upon at the time of the transaction. The best I can do pricing wise is adjust if Crystgin prices change.
  • Please read this entirely and carefully. I will refuse your commission inquiry if you do not agree to these terms and rules. If you are not comfortable with my Terms Of Service and/or are not willing to agree to them, you may not request a commission.
  • Violators will be added to a blacklist indefinitely and without warning with any additional appropriate actions taken.
  • You may display my work on external sites as long as it is visibly credited and linked back to me, and/or my watermark or signature have not been obscured. You may not upload or host my work in any gallery that is intended to display your own work only, and you may not claim my work as your own.
  • Please only upload the watermarked file publicly unless otherwise discussed.
  • You may use the artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays. You reserve the right to print or create an otherwise physical reproduction of the artwork as long as it is for your PERSONAL use only (ie. NOT for sale). You may not use the Artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc).
  • Do NOT, under ANY circumstance, utilize my artworks such as images, goods, and copies of goods in any block-chain related technology including non fungible tokens (NFT), cryptocurrency, or future inventions in the space, or utilize such artworks to train, validate, or test any neural network or artificial intelligence. Doing so is in violation of terms against alteration and external non private use of artwork that's been commissioned.
  • You are NOT authorized to change, modify, edit or use my works without my permission, and you are NOT authorized to trace over my artwork in any way, including the use of the artwork as a “base.”
  • Any harassment in an attempt to bargain for a commission when my commissions are closed or my queue is full is not tolerated. This includes inappropriately worded comments on any of my social platforms, as well as private messages. I reserve the right to place anyone on a blacklist over harassment.

ARTIST

  • I reserve the right to decline any project or client for any reason.
  • I reserve the right to sign and/or watermark my own work. You will be given 2 versions of the artwork, one with and one without watermarks; but both will contain my signature somewhere regardless.
  • I will send you said files of the artwork, as per previously mentioned, in a .rar file in .png format, through either Discord or email.
  • You are responsible for protecting your ownership over rights to a character design made by me by creating a copy image with your name added as well (ie. through a watermark) when uploading on external sites.
  • I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a public commission, I may do whatever I wish with the art (eg. post it to other sites such as Aethy or Bluesky if applicable) but will give proper credit to you for ownership of the character’s design, unless you requested for anonymity during the ordering process, as previously mentioned.
  • I will not claim the rights to a character design, therefore I will not reuse/resell the artwork for personal (unless given permission) or commercial projects.
  • There may be slight differences between the samples in my gallery and the illustration you will receive. The client must respect that my artistic style cannot be altered at will due to the nature of my dissociative identity disorder and frequent amnesia and/or skill rot. I reserve the right to reject critiques pertaining to artistic skill and stylization, and if the critique reduces the artistic quality of the piece.
  • Credit to me, the Artist, is required when you post or use it on another platform.
  • You, the client, are responsible for saving any information, images, and other digital data I provide, except for the User ID Login (liable to change).
  • Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 6 months. However, I cannot guarantee against computer failure or accidental deletion or loss.
  • I am not required to post your project in any public space, and if posted, I am not required to keep it there indefinitely. I have the right to delete or remove any public project, even if you paid for it, as you should have your own copy for personal use.
  • Feedback of the final piece is permitted after completion of the piece, through private messages or comments.
  • Any comments that are rude, inappropriate, inflammatory, and/or non-constructive may result in blacklisting.

General

Okay, with some legalese out of the way, here's an actually readable list of things to keep in mind or while you come to me for a commission!

Ordering

  • I reserve the right to reject the offer for a commission for any reason.
  • Any emails, private messages, and comments that you send must be in English. Miscommunication due to mistranslation is at fault of the client if they cannot communicate in English.
  • I prefer Discord for communication; my handle being @vyxenificous.
  • Before taking part in any transaction, you are required to wait for a reply so that we can discuss the details; I refer to this as the ordering process. This is when the client sends me references, pose references, and gradient maps or palettes for the artwork, and I inform them of the price and/or any additional details I need.
  • I will send you, on Discord, a .rar with 2 uncompressed .pngs of the artwork once completed: one with a watermark and one without a watermark, but if necessary or if preferred, I'll email it to you (for files over 10 MB).
  • Full references are heavily encouraged, as I'm not providing design commissions. As much as I love reading about OCs, I'm a very visual person! Even so much as a picrew will help you steer me in the right direction as to how you'd like your character to look like; the more detail the better. Additionally, if you have a composition/pose in mind I’d appreciate images for that too! If you don’t have references, you can come back to me with them later. References are required to finish your order for me to be able to begin my work.
  • During this ordering process, especially for gradient map commissions or palette colored commissions, if you'd like for me to use a specific palette or gradient map, please inform me during the ordering process! You can send me images, or link palettes to me from Lospec, for example. If not clarified, I will use what I deem fit for gradient maps and my usual Gloomy Weather palette.
  • Palettes that follow a linear scale of value in their colours (dark to white) can be used as gradient maps! For example, the Ennis Blade palette by Vsigos (19 colors) counts as a gradient map and is value-linear, whereas Fantasy-24 by Gabriel C. (24 colors) counts as a palette instead.
  • I will usually post commissioned works on my social media unless you specify otherwise! You can also specify if you'd like to be mentioned directly or not in any posts or whether you'd prefer to remain anonymous. I will often share WIPs privately to friends and post the full watermarked pieces on Aethy and Bluesky (if applicable), so please make sure you inform me before any work has begun.

Payment

  • You must be able to pay through one of the payment services Netease accepts: PayPal, Google Pay, ApplePay, Paysafecard, Cash App Pay, Klarna, 支付宝, Wechat Payments, Netease Credit or your standard Credit/Debit card, such as Mastercard or Visa. (You are free to go to their page and check if your card is accepted; linked below)
  • The price is to be paid upfront before work begins and after the commission details, when both parties are at full agreement, are settled. I refer to this as finishing the ordering process.
  • Please keep in mind that if you are handling a currency different from USD, to perform the conversion yourself first to be aware of how much you'll be spending, before you actually spend it, and keep in mind certain payment processors can and will tax you for it, too.
  • I will — after everything is confirmed — send you the information you need in order to perform a User ID Login on Netease's Top Up page. If necessary, we can figure out a time and date where we are both available: me, to be in-game, and you, to perform the payment. You must confirm with me if the login is correct before performing any purchases, and I will be in-game to let you know if and when the Crystgin comes through into my account. Once it does, I may begin the work on your order.
    • The only options you'll be looking at are:
      • USD 0.99 — for 1 USD commissions
      • USD 4.99 — for 5 USD commissions
      • USD 14.99 — for 15 USD commissions
      • USD 29.99 — for 30 USD commissions
      • USD 49.99 — for 50 USD commissions
      • USD 99.99 — for 100 USD commissions
    • Everything else can be considered moot.
  • Since we're dealing with a virtual currency; I, the artist, in good faith, will not spend the Crystgin until your order is complete and delivered to you.

Pricing

You've probably seen my commission sheet already (and it's probably how you're here), but just in case (and for documentation's sake):

  • Bust-ups: 1~15 USD
    • Lineart Only: 1 USD
    • Gradient Map: 5 USD
    • Palette Colored: 15 USD
  • Waist-ups: 15~50 USD
    • Lineart Only: 15 USD
    • Gradient Map: 30 USD
    • Palette Colored: 50 USD
  • Note: Each extra characters will add to the final price of a commission, equal to what they would cost as a separate commission. I will allow up to 3 characters in a commission, and no more than 3. A palette colored waist-up with 2 characters will be 100 USD and one with 3 characters, 150 USD, for example; while a lineart only bust-up of 2 characters will be 2 USD and one with 3 characters, 3 USD.
  • In case of doubt: ask! I will always let you know the full price before any payments are made and any work begins.

Limitations

Keep in mind that, although I do my best, I am still limited by skill! Here's a brief list of what I can/can't, or will/won't draw:

  • I can and will draw: fanart, OCs, furries/anthros, risqué/soft NSFW, mild injury, blood and gore (organs are fine but I'm not a medical expert);
  • I can't draw (skill issue, wish I could): bara (intense musculature), mecha/complex armour/weaponry, hyperrealism, complex backgrounds, major gore, hard NSFW (i suck ass at it I'm so sorry, tits out/topless is ok tho);
  • I won't draw certain media: there are many shows, games, movies, fan content, etc. I will decline drawing for, especially if I have personal distaste or trauma concerning them.
  • If you're not sure whether or not I'll draw something, just ask! This is especially true concerning fetishes on soft NSFW pieces. (Honestly as long as I'm not having to draw genitals, chests aside, I really do not care 90% of the time. Again, ask!)

Not particularly limited by skill but moreso by disability, I do not offer rendered/shaded pieces or full bodies as part of my commissions, even though they are in my gallery, due to:

  • a) the pain and strain it takes on my wrist and hands;
  • b) time needed;
  • c) having a tendency to burn me out very easily, which is Kind of Bad, Actually, and I'd like to avoid that!

Deadlines

Because life happens and boy, does it like to kick me in the nuts. Very, very frequently.

  • I can usually take 1~3 days to respond to the initial inquiry for an order, but I will attempt to be timely if possible.
  • I reserve the right to take up to 1 week to begin work on your commission, and an additional 3 to work on said commission as needed. Again, 2 jobs and disabled, sometimes shit can just happen; I will try to, again, be timely if it is within my possibility!
  • Depending on both my current commission queue and real-life workload, the working time should take no longer than 3 weeks (after the 1st week I reserve to begin the work). I will provide an estimate time for completion, and/or indicate if there is a delay in completing your commission.
  • Reminders and check-ins are fine, after the first week of working time has passed.

Process

  • The responsibility is on you to ensure your order contains the details you want me to follow. I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.
  • Up to two major revisions can be made during the sketching phase of the commission. Only minor adjustments, within reason can be made afterwards to the lineart. Any major changes to the artwork past sketching (such as a pose change during lineart) will be subject to a fee, and the fee will depend on the nature of the change. Color corrections will be made at the color stage free of charge.
  • In the absence of feedback from the client, any changes to the final piece will be declined.
  • Each time I send a WIP to a client, I ask the client to provide feedback to me. If no suggestions are requested the client is held responsible for dissatisfaction with incorrect details. It's likely that if it's my first time drawing a character or if the references provided aren't sufficient in that particular aspect I'm sketching, lining or colouring, that I will go to you and ask about it; either for more references, or for clarification, for example.
  • You may request a WIP at any time, with preferably 2 days or more in-between WIP requests. If the above happens where we're already in a discussion about a certain element and/or a reference, asking for a WIP is perfectly fine! WIPs will be sent usually through Discord and unfortunately get compressed and crunchy.
  • I will not be held responsible for any changes in ownership of the said character.
  • After the artwork is completed, minor changes such as color adjustments are allowed if the missing or inaccurate elements are my faults (e.g., I overlooked details provided in the order).
  • I will not redraw a completed commission unless payment is received for a second order, or I refund the client through commission credits (refer to Refunds).

Refunds

There are no refunds in Ba Sing Se... (No, really. How do you expect me to refund this stuff?)
Jokes aside, I can't really promise you a refund, but moreso credit.

  • a) If for some reason I cannot finish your commission within a reasonable time (as stated above; 4 weeks total), I will go to you to discuss a solution: be it more time, starting over from scratch at no extra charge, or even giving you the option to later commission me again for a reduced price (commission credit) if not for free depending on severity.
  • b) I will try my best to be lenient and flexible according to the situation, what went wrong, why it went wrong, and what I and/or the client can do or improve on to make sure it either does not happen again, or that there are terms and contingencies for if it does, including updating this list of Terms of Service and my conditions for commissions.
