Terms Of Service

1. CLIENT
- (1.1) You, the Client, will be expected to first read my TOS and understand my general Commission Prices. By commissioning me, you are purchasing my service as an artist only, and by purchasing my services (art), you agree that you have read and accepted all the terms described herein.
- (1.2) Terms of Service and Prices are subject to change at anytime. Please keep such a fact in mind; pricing may change as my situation fluctuates, and payment methods may be added or removed depending on what I need. You are free to ask me to notify you, in particular, once these changes apply; such as a specific payment method you prefer, or adjustments to prices.
- (1.3) Please read this entirely and carefully. I will refuse your commission inquiry if you do not agree to these terms and rules. If you are not comfortable with my Terms Of Service and/or are not willing to agree to them, you may not request a commission.
- (1.4) Violators will be added to a blacklist indefinitely and without warning with any additional appropriate actions taken.
- (1.5) You may display my work on external sites as long as it is visibly credited and linked back to me, and/or my watermark or signature have not been obscured. You may not upload or host my work in any gallery that is intended to display your own work only, and you may not claim my work as your own.
- (1.6) Please only upload the watermarked file publicly unless otherwise discussed and I have given you permission to do so.
- (1.7) You may use the artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays. You reserve the right to print or create an otherwise physical reproduction of the artwork as long as it is for your PERSONAL use only (ie. NOT for sale). You may not use the Artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc).
- (1.7a) As an addendum: for any commissions concerning “canon” or copyrighted character designs, you are still not allowed to utilize my artwork for commercial means, even if you yourself did not commission the artwork in question.
- (1.8) Do NOT, under ANY circumstance, utilize my artworks such as images, goods, and copies of goods in any block-chain related technology including non fungible tokens (NFT), cryptocurrency, or future inventions in the space; additionally do not utilize such artworks to train, validate, or test any neural network or artificial intelligence. Doing so is in violation of terms against alteration and external non private use of artwork that’s been commissioned, and you will be subject to being blacklisted permanently.
- (1.9) You are NOT authorised to change, modify, edit or use my works without my permission, and you are NOT authorised to trace over my artwork in any way, including the use of the artwork as a “base.”
- (1.10) Any harassment in an attempt to bargain for a commission (or, for instance, a ‘slot’ including slots on a waiting list) is not tolerated. This includes inappropriately worded comments on any of my social platforms, as well as private messages. I reserve the right to place anyone on a blacklist over harassment.
2. ARTIST
- (2.1) I reserve the right to decline any project or client for any reason; I reserve, as well, the right to choose if I explain or justify declining a project or client.
- (2.2) I reserve the right to sign and watermark my own work. You will be given 2 versions of the artwork, one with and one without watermarks; but both will contain my signature somewhere regardless.
- (2.3) I will send you said files of the artwork, as per previously mentioned, in a .rar file in .png format, through either Discord or email. I do not send .psd, .mdp or .kra files.
- (2.4) You are responsible for protecting your ownership over rights to a character design made by me; such as by creating a copy image with your name added as well (ie. through a watermark) when uploading on external sites.
- (2.5) I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a public commission, I may do whatever I wish with the art (eg. post it to other sites such as Aethy or Bluesky if applicable) but will give proper credit to you for ownership of the character’s design, unless you requested for anonymity during the ordering process, as previously mentioned.
- (2.6) I will not claim the rights to a character design, therefore I will not reuse/resell the artwork for personal (unless given permission) or commercial projects. An exception applies here if you commission me artwork of my own character designs.
- (2.7) There may be slight differences between the samples in my gallery and the illustration you will receive. You, the client, must respect that my artistic style cannot be altered at will due to the nature of my dissociative identity disorder and frequent amnesia and/or skill rot. I reserve the right to reject critiques pertaining to artistic skill and stylization, and if the critique reduces the artistic quality of the piece.
- (2.8) Credit to me, the Artist, is required when you post or use it on another platform; see section 1.5 above
- (2.9) You, the client, are responsible for saving any information, images, and other digital data I provide, and you are to be private about my personal details. Failure to do so, such as leaking my information, doxxing me or otherwise bringing harm or threat to my safety through this data is grounds for permanent blacklisting.
- (2.10) Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 6 months. However, I cannot guarantee against computer failure or accidental deletion or loss.
- (2.11) I am not required to post your project in any public space, and if posted, I am not required to keep it there indefinitely. I have the right to delete or remove any public project, even if you paid for it, as you should have your own copy for personal use.
- (2.12) Feedback of the final piece is permitted after completion of the piece, through private messages or comments.
- (2.13) Any comments that are rude, inappropriate, inflammatory, and/or non-constructive may result in blacklisting, again see section 1.10 in concerns to harassment.
3. ORDERING
- (3.1) Before taking part in any transaction, you are required to wait for a reply so that we can discuss the details of, including but not limited to; characters, poses, palettes, the total of your order with clarifications if needed, payment options, and references. I refer to this as the ordering process. It is completed when the client and I come to an agreement, accepting the final price of the order, and move on to the payment process.
- (3.2) I reserve the right to reject the offer for a commission for any reason, and I am not required to justify the reason why. See section 2.1. It is rare that I do not, but in most occasions, I will try to provide a reason why.
- (3.3) Any emails, private messages, and comments you send me send must be in English. Miscommunication due to mistranslation is at fault of the client if they cannot communicate in English.
- (3.4) I prefer Discord for communication; my handle being @vyxenificous.
- (3.5) I will send you, on Discord, a .rar with the uncompressed .png of the artwork, but if necessary, I’ll email it to you for files over 10 MB (50 if I have Nitro). As mentioned in section 2.3, I will not send the client .psd, .kra or .mdp files of my work.
- (3.6) If the client requires proof of my artwork, I will happily share a screenshot or video of me working or of messing with layers.
- (3.7) Full references are heavily encouraged and needed, as I’m not providing design commissions. They are required for the ordering process. If you do not have references on hand, you can return to me with them later, but the ordering process will be paused and will not be completed until then.
- (3.7a) Acceptable reference images include but are not limited to: Neka.cc pictures, Picrew pictures, non-AI generated “face claims” or art resembling the character, palettes, previously drawn or commissioned artwork of the character (be it mine or not), pose references, and composition references.
- (3.7b) I may request any of the above for further visual aid in completing your order.
- (3.8) I will likely post commissioned works, watermarked, on my social media unless you specify otherwise. See section 2.5. You can also specify if you’d like to be mentioned or credited directly or not.
- (3.9) I will often share WIPs privately to friends, so please make sure you inform me whether you do not wish for me to do so before any work has begun.
4. PRICING

- (4.1a) I will permit up to 2 additional characters in an order. One additional character will incur a 50% fee and two additional characters will bring that to 75% instead.
- (4.1b) For an additional 20% fee as well, I can expedite you on my queue and waiting list (refer to section 7.6) and attempt to complete your order within one working week rather than three.
- (4.1c) Expanded below in section 5.2, any PayPal payments will have a 20% fee atop the final price, after any and all fees.
5. PAYMENT
5.1. Bank Transfers or Direct Payments
- (5.1a) The price is to be paid upfront: before work begins and after the commission details are settled and both parties have come to an agreement about all relevant details, and the client agrees to the final price of their order. I refer to this as finishing the ordering process (see section 3).
- (5.1b) The price to be paid once the ordering process is finished is 50% of the total order’s final price. The remaining 50% is to be paid upon the order being completed, and the artwork delivered. Failure to pay the latter half within a week of delivery (or until otherwise negotiated) is grounds for blacklisting.
- (5.1c) Inform me first and foremost which currency (and service) you’ll be using to pay me. I give priority to EUR payments due to SEFA, and direct Wise payments have the smallest fees and waiting time possible. Refer below for terms concerning PayPal payments.
- I can accept other currencies, such as AUD, CAD, CHF, CNY, GBP, JPY, and USD strictly for bank transfers and direct payments. Due to the current tax reform pending in Brazil, I am not accepting BRL at this time until things stabilize. Personal exceptions (ie friends) can be made.
- (5.1d) I will generate a payment code for you to pay me with; simply inform me of the currency you’ll be paying in first and I’ll share the link with the respective value to be paid.
- (5.1e) If you have a Wise account, you can use the link directly, and the transfer should take at best 2 days. This is regarded as a direct payment. If not, you can get the necessary details for a bank transfer through the link, and ask me for them as well as needed, though this has more fees and more waiting involved. I will inform you as soon as the payment comes in; it takes (not accounting for holidays) approximately 6 to 7 days.
5.2. Bank Transfers with PayPal
- (5.2a) As an addendum about Paypal: bank transfers can be made through the payment link using PayPal (presumably they’ll recognise it as a withdrawal bank), however;
- (5.2b) It is not my responsibility if PayPal closes your account or otherwise punishes you for sending me money. I am dead serious, and it is part of the reason why I discourage PayPal payments here;
- (5.2c) I cannot guarantee refunds for any payments made with PayPal’s services;
- (5.2d) Any and all orders paid with PayPal will have a 20% fee upon the final price of the order to cover for PayPal’s exploitative fees over payments made through their service.
- (5.2e) Failure to inform me you’ll be using PayPal to pay me is grounds for blacklisting.
6. LIMITATIONS
- (6.1) I can and will draw: fanart, OCs, furries/anthros (ferals might not turn out that good), mild injury, blood and gore (organs are fine but I’m not a medical expert), yumeshipping, anything not below. If you’re not sure, feel free to ask;
- (6.2) Due to a limitation of my skills I will not draw: bara (intense musculature), mecha/complex armour/weaponry, hyperrealism, complex backgrounds, and major gore;
- (6.3) I decline to draw certain media: there are many shows, games, movies, fan content, etc. I will decline drawing for, especially if I have personal distaste or trauma concerning them. I do my best to put aside my tastes, but if it cannot be ignored and will impair the final result, I will decline the order.
- (6.4) I additionally will be very cautious of risqué and NSFW orders (to comply with Wise’s terms of service). This is not a reflection of my political or moral standing, this is legal compliance. I will not post the artwork of these orders to my platforms.
7. DEADLINES
- (7.1) I can usually take 1~3 days to respond to the initial inquiry for an order, but I will attempt to be timely if possible.
- (7.2) I reserve the right to take up to 1 week to begin work on your project, and an additional 3 to work on said project as needed. These 3 weeks are referred to as my working weeks. Again, 2 jobs and disabled, sometimes shit can just happen; I will try to, again, be timely if it is within my possibility.
- (7.3) Depending on both my current commission queue (current slots and waitlist) and real-life workload, the working time should take no longer than 3 working weeks. I will provide an estimate time for completion, and/or indicate if there is a delay in completing your commission.
- (7.4) I reserve up to an additional working week should there be a delay.
- (7.5) Reminders are fine, after the first working week has passed.
- (7.6) As delineated in section 4.1b, for a fee, I can reduce the 3 working weeks to one work week and give you priority on my commission queue; if you are in the waiting list, I will slot your order into my queue as soon as I can, and if you are in the queue, I will give priority to completing your order first.
8. PROCESS
- (8.1) The responsibility is on you to ensure your order contains the details you want me to follow. I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.
- (8.2) Up to two major revisions can be made during the sketching phase of the commission. Only minor adjustments, within reason can be made afterwards to the lineart. Any major changes to the artwork past sketching (such as a pose change during lineart) will be subject to a fee, and the fee will depend on the nature of the change. Color corrections will be made at the color stage free of charge.
- (8.3) In the absence of feedback from the client, any changes to the final piece will be declined.
- (8.4) Each time I send a WIP to a client, I ask the client to provide feedback to me. If no suggestions are requested, the client is held responsible for dissatisfaction with incorrect details. It’s likely that if it’s my first time drawing a character or if the references provided aren’t sufficient in that particular aspect I’m sketching, lining or colouring, that I will go to you and ask about it; either for more references, or for clarification, for example.
- (8.5) You may request a WIP at any time, with preferably 2 to 3 days or more in-between WIP requests, once the first working week begins. If the above happens where we’re already in a discussion about a certain element and/or a reference, asking for a WIP is perfectly fine! WIPs will be sent usually through Discord and unfortunately get compressed and crunchy.
- (8.6) I will not be held responsible for any changes in ownership of the said character.
- (8.7) After the artwork is completed, minor changes such as color adjustments are allowed if the missing or inaccurate elements are my faults (e.g., I overlooked details provided in the order).
- (8.8) I will not redraw a completed commission unless payment is received for a second order.
9. REFUNDS
- (9.1) I cannot promise refunds for any PayPal-paid payments made to me, but I can promise them for any other bank transfer payments and direct payments.
- (9.2) If for some reason I cannot finish your commission within a reasonable deadline, or due to some other issue occurring with your order (ie. medical emergency or some other occurrence that leaves me unable to complete it) I will go to you to discuss a solution. Other causes for a cancellation of a commission already past the ordering stage, so long as they are reasonable and justifiable by either party, may also apply here.
- (9.3) In case a commission or order is cancelled; either by me, the artist, or the client; should it be applicable and requested by the client, I will refund what has been paid of the order to the client as soon as is possible.
- (9.4) Other solutions may include giving me more working time to finish the order; or giving you a discount worth the order’s price for the current or for future commissions.
- (9.5) I will try my best to be lenient and flexible according to the situation, what went wrong, why it went wrong, and what I and/or the client can do or improve on to make sure it either does not happen again, or that there are terms and contingencies for if it does, including updating this list of Terms of Service and my conditions for commissions.
