TERMS OF SERVICE
The English version of the TOS was created in order to make the contracting of services more accessible, and in no case will a translation error serve as an excuse for not following them. If there were to be a discrepancy between the English and Spanish versions, the most restrictive of the two will prevail.

I am constantly looking to improve and I'm open to drawing almost anything that is not included in the "won't draw" list. However, please keep in mind my skill level might not be the same, so the result may not look as good as if I were to draw something I'm better at!
I reserve the right to refuse to take any commission I'm not comfortable with.
By commissioning me, you agree to the Terms Of Service stated below:
TERMS & CONDITIONS
- Returning clients must re-agree to the latest TOS provided by the artist.
- The client agrees not to file a chargeback at any point throughout the process, instead resorting to clear communication during the revision process to state anything they might not be happy with. (Requesting a chargeback will result in being added to a blacklist and publicly exposed).
- The artist reserves the right to cancel the commission without issuing any refunds if the client breaks the TOS in any way.
- The artist reserves the right to post watermarked versions of commissioned pieces or posting the process on their own platforms for promotional purposes. NDA/PRIVATE ORDERS WILL HAVE A PRIVACY FEE.
- Commissions are for personal use only unless the pertinent fee has been paid (refer to the "ADDITIONAL FEES" section
ARTIST OBLIGATIONS
- The artist undertakes to be receptive to feedback during the revision process, as long as they're reasonable.
- The artist will provide a flat coloured version and a transparent PNG of the final artwork upon request.
- The artist will ensure full transparency of the process via his progress tracker website and his to-do list, keeping the client informed at all times.
- The artist undertakes to comply with the deadlines, making every effort to finish as soon as possible. The artist is not responsible for delays resulting from late responses from the client. Please make sure to provide a method of communication you check often.
- The artist will update the client a minimum of one time per week. In addition, he will reach out every time he makes any kind of progress.
- The artist will send the final product to the client via their preferred method (Google Drive, Discord, email...). However, he might delete the files overtime due to storage issues, and he does not take responsibility for any lost artwork. Please make sure to download a copy of the commission as soon as possible.
CLIENT OBLIGATIONS
- The client agrees to having read and agreed to the Terms of Service, expressing any doubts they might have and clarifying them BEFORE starting the commission process.
- The client undertakes to communicate as openly, clearly and effectively as possible during the process, letting the artist know about their honest opinion during each revision process and making sure to be fully satisfied with the result before progressing to the next stage (rough sketch -> cleaned up sketch, cleaned up sketch to base colours, etc.)
- The client agrees to being happy with the look of the artwork at the moment of approving it before the artist continues with the commission. Each revision will allow changes to the current stage (e.g: no changes to the pose during lineart/cleanup, no changes to the base colours during rendering).
- The client declares that any and all information regarding the future usage of the commission is true and well-intentioned. It is the client's responsibility to state whether they'll be using the commission for personal, promotional or commercial use, which will incur in a fee. Hiding your true intentions in order to avoid extra fees will result in being added to a blacklist and publicly exposed.
- The client undertakes to properly, visibly and directly credit the artist every time they use or post the artwork, via a direct link or tag to the artist or their socials (@lumikadraws).
PAYMENT
- Payment will be done in EUROS THROUGH PAYPAL/KO-FI ONLY.
- Payment must be upfront. 50/50 split payments may be discussed for orders over 50€.
- Clients will have 24h to pay after the invoice has been sent. Failure to deliver payment within the stated time will result in the cancellation of the commission and the client will lose their spot on the waitlist, if any.
PROCESS
- TurnAround Time (TAT): depends on the complexity of the artwork, the amount of slots taken and the artist's personal circumstances.
- Generally, commissions will progress as follows: rough sketch/thumbnailing → cleaned up sketch/lineart → base colours → rendering/shading (might change depending on the commission type).
- The first 3 revisions are free. To encourage clients to be reasonable and clear with their requests, any modification done outside of the revisions included with the price will require an extra fee. Please make sure to specify everything you're not happy with during every revision process to avoid delays in the delivery
Important
Revisions and changes are not the same.
- Revisions: each time the artist sends an update and the client expresses ALL of the changes they'd like to make.
- Changes: any modification the client wishes to make to the commission. They are included in the revisions.
USAGE:
- Commissions are for personal use only (profile pictures, banners, posting to social media with direct credit, printing for room decor). Any benefit the client could gain from it, be it monetary or promotional counts as promotional/commercial use and will require an extra fee.
- Uploading the artwork to any blockchain-related technology/network (including but not limited to NFTs, cryptocurrency, etc.) is strictly forbidden.
- Usage of the artwork in AI programs or algorithms of any kind is strictly forbidden.
- Editing the artwork is strictly forbidden. Please make use of the multiple revisions included in your commission to adjust anything you're not satisfied with.
- Clients may not modify the artwork in any way, or hire another artist to do so.
- Clients may not ask other artists to "complete" the artwork (e.g. giving them the lineart/cleaned up sketch for them to colour/render).
- Copyright to the artwork is not transferred to the commissioner/client.
- The artist reserves all rights to the artwork, including, but not limited to its distribution, reproduction and self-promotion.
ADDITIONAL FEES:
- NDA/PRIVACY FEE: ensures the commission process is kept entirely private.
- RUSH FEE: necessary if the given timeframe for completition is too small.
- PRIORITY FEE: allows the commission to be positioned further up in the queue and worked on sooner than other orders.
- PROMOTIONAL USE FEE: allows vtubers/content creators to use the artwork as their brand image (icons, banners, pinned posts, references, Twitch panels, etc.). This tier DOES NOT allow the commissioner to use the artwork for merch, be it physical, digital or in any other format.
- COMMERCIAL USE FEE: required if the commissioner wishes to create any kind of merchandise with the artwork. In return, they will be sent a high quality/high resolution file and the colours used will be adapted for printing.
- COMPLEXITY FEE: charged when the client's character or idea entails highly detailed designs, poses, accessories, backgrounds, etc.
Trying to avoid extra fees will result in being banned from commissioning me ever again and being publicly exposed.
CREDITS
- Clients must give direct, clear and visible credit every time they post or use the artwork (no @. @/ or similars). Hiding or gatekeeping the artist's handle will result in being added to the blacklist.
REFUNDS
- No refunds after payments have been sent. Please be sure you can commission me before going through with the process. I do not take responsibility for anything out of my control that may happen on your end and will only send a refund if I'm unable to complete the commission.
I will offer more than enough revisions to make any necessary changes, within reason. I will not offer a refund if you're unsatisfied with the results after the previous stages have been approved. Please make sure to state everything you're not satisfied with and provide enough references for me to accurately match your ideas. I do not take responsibility for any unincluded details if you haven't mentioned wanting them beforehand.
Backing out due to insatisfaction with my progress after I've already started the commission is not allowed either and I will not grant you a refund in this case. Please make use of the included number of revisions to fix any inaccuracies on my end.
